Terms of Service
1. General Agreement & Scope
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Cristal Fondelle ("Company", "Cristal Fondelle", "we", "us", or "our"). These Terms apply to all visitors, registered users, and third parties who access the Cristal Fondelle platform, software utilities, algorithmic signal modules, and digital interfaces.
If you disagree with any segment of these Terms, you must immediately terminate access to our interface and refrain from utilising our platform or software services.
2. Educational Nature & No Financial Advice
The Cristal Fondelle platform offers software interfaces, computational simulations, algorithmic market models, and automated execution scripts for digital assets and foreign exchange data. All materials, analytics, automated signal outputs, and performance metrics presented across the platform are published exclusively for educational, technical, and informational purposes.
Cristal Fondelle is not an authorised investment manager, asset custodian, broker-dealer, or financial advisor under the Financial Services and Markets Act 2000 (FSMA) or regulations enforced by the Financial Conduct Authority (FCA). None of the communications, technical calculations, or software outputs constitute bespoke financial advice, tax planning, investment recommendations, or an endorsement to buy, hold, or liquidate any financial asset.
3. Eligibility & User Representations
By accessing or interacting with Cristal Fondelle, you explicitly warrant that:
- You are at least 18 years of age and possess full legal capacity to enter into binding contractual commitments under the laws of England and Wales or your domestic jurisdiction;
- You are not subject to any statutory, commercial, or international sanctions that prohibit participation in trading digital assets;
- You are fully responsible for ensuring that your access to our algorithmic software complies with all applicable local statutory frameworks, territorial restrictions, and currency controls;
- Any credentials, contact parameters, or registration details submitted by you are accurate, current, and verifiable.
4. User Accounts & Security Obligations
Access to designated platform features may necessitate creating an account. You retain exclusive responsibility for safeguarding the confidentiality of your login tokens, API keys, and account identifiers. You accept full liability for any instructions, transactions, or communications initiated through your credentials.
If you identify an unauthorised intrusion, breach of credential integrity, or suspected compromise of your access keys, you must notify Cristal Fondelle administration immediately. We disclaim all liability for financial, data, or operational losses arising from user negligence regarding key security.
5. Risk Disclosure & Market Volatility
You acknowledge that digital currency markets, spot tokens, derivative contracts, and foreign exchange instruments exhibit extreme volatility, illiquidity risks, and systemic counterparty hazards. Automated algorithms, technical signal indicators, and automated routing mechanisms are inherently prone to market slippage, connectivity latency, platform downtimes, and abrupt market shocks.
Past algorithmic simulations or historic backtested metrics do not predict or guarantee prospective commercial returns. You participate entirely at your own risk, and you acknowledge that trading speculative instruments may result in the total liquidation and loss of all allocated capital.
6. Intellectual Property Rights
All software architectures, source code, visual layouts, brand assets, logos, proprietary models, computational equations, interface patterns, and text displayed on Cristal Fondelle are the exclusive intellectual property of Cristal Fondelle or its licensors. Users receive a limited, revocable, non-exclusive, non-transferable licence to view and use the website for private non-commercial operations.
You may not reverse-engineer, decompile, scrape, republish, redistribute, mirror, or extract source algorithms from the platform without explicit written authorization signed by an authorised officer of Cristal Fondelle.
7. Prohibited Platform Conduct
When interacting with the platform, you strictly agree not to:
- Deploy automated scrapers, bots, spiders, or intrusion tools that degrade server infrastructure or harvest platform data;
- Introduce malicious code, trojans, worms, or disruptive scripts designed to compromise system availability;
- Utilise the platform for illicit capital transfers, money laundering, market manipulation, or fraudulent trade structuring;
- Circumvent territorial geofencing mechanisms, IP filters, or identity verification gates established by the Company.
8. Limitation of Liability
To the fullest extent permitted under applicable law, Cristal Fondelle, its directors, developers, contractors, and affiliates shall not be liable for any direct, indirect, consequential, punitive, incidental, or exemplary damages. This includes, without limitation, loss of trading profits, depletion of account balance, data corruption, network latency losses, or third-party broker defaults, whether sounding in contract, tort (including negligence), or statutory duty.
9. Indemnification
You agree to defend, indemnify, and hold harmless Cristal Fondelle and its affiliates against any third-party claims, liabilities, statutory fines, legal expenses, or financial damages resulting from your breach of these Terms, unlawful behaviour, or reliance on trading automation software.
10. Governing Law & Dispute Resolution
These Terms, their interpretation, and any non-contractual disputes or claims arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to adjudicate any controversy arising under this agreement.
11. Amendments & Contact
Cristal Fondelle reserves the right to amend, alter, or replace these Terms at any time. Changes become operative upon publication to this page. Continued access following revisions confirms your irrevocable assent to updated terms.
